SEOUL, April 1 (Yonhap) -- Omega X's agency, IPQ, announced plans for their response following the final ruling on the termination of their exclusive contract with their former agency, Spire Entertainment.
IPQ stated on the 1st, "The Korean Commercial Arbitration Board has acknowledged the physical assault, verbal abuse, sexual harassment, and threats committed by former Spire executive director surmaned Kang, thus concluding the termination of the exclusive contract due to violation of the 'guarantee of personal rights' clause within the contract."
They continued, explaining, "Due to Mr. Kang's contractual violations and illegal actions, significant psychological damages incurred by Omega X members have been recognized, and the claim for compensation has been deemed justifiable."
Previously, Omega X had won a lawsuit against Spire Entertainment in January last year, which suspended the effectiveness of their exclusive contract. Following this, in March of the same year, they attempted to reach a three-party agreement regarding the termination of the exclusive contract and the transfer of intellectual property (IP). However, according to IPQ, Spire Entertainment continued to assert their rights under the exclusive contract and spread false information.
IPQ asserted, "Since Spire Entertainment caused reasons for nullifying the three-party agreement, we are taking steps to nullify the agreement. According to the nullification, the 5 billion won in distribution advance payment made by Danal Entertainment (distributor) should be returned by Spire Entertainment."
Additionally, regarding the allegations raised by Youtuber In Ji-woong about tampering (pre-contact before termination of exclusive contract) related to Omega X, IPQ stated, "In Ji-woong has violated the court's publication ban and continues to publish videos," adding, "We plan to demand enforcement fines."
According to IPQ, Kang's assault case has been referred to the prosecution for supplementary investigation, and his sexual harassment case is under police investigation.
