Appeals court upholds 2-yr prison term for retired general over martial law involvement

SEOUL, Feb. 12 (Yonhap) -- An appeals court on Thursday upheld a two-year prison sentence for retired Army Maj. Gen. Noh Sang-won for collecting the personal information of military intelligence agents in connection with the brief imposition of martial law in 2024.

The Seoul High Court upheld a lower court ruling that found Noh, a former commander of the Defense Intelligence Command, guilty on charges of violating the personal information protection law and other offenses.

Noh had been indicted for receiving military intelligence, including personal information of the command's agents, from military commanders in 2024 in order to create an organization to investigate allegations of election fraud after ex-President Yoon's martial law declaration.

He was also charged with receiving 20 million won (US$13,900) worth of cash and gift certificates worth 6 million won from military officers in exchange for his promise to help their promotions.

"The lower court ruling that found the formation of the investigative team unconstitutional and illegal is just," the court said.

Noh is also standing trial on charges of playing a key role in an insurrection in connection with Yoon's failed martial law bid.
