SEOUL April 25 (Yonhap) -- Actor Baek Yoon-sik has partially won a lawsuit against his former partner's published essay, with both the first and second trials ruling in his favor.
The Seoul High Court's Civil Division 9 (Presiding Judges Sung Ji-yong, Baek Suk-jong, and Yoo Dong-kyun) on the 25th dismissed the appeal of the defendant in the lawsuit filed by Baek against the publisher of his former partner A's book, ruling in line with the first trial's decision, which partially favored the plaintiff.
However, the court did not disclose specific reasons for its ruling on this day.
In May of 2023, the first trial stated, "Without deleting private contents, publication, printing, reproduction, sale, distribution, and advertising activities should not be carried out," instructing the deletion of direct and specific expressions of sexual relations, Baek's health information, and family conflicts from the book.
Especially, it ordered the recall and disposal of already distributed books, stating that the value of expression or publication should not be considered superior to the need to protect the plaintiff's honor or privacy, nor does the disclosure of the plaintiff's privacy appear to be for the public interest.
A, a journalist, attracted attention in 2013 for her relationship with Baek, who is 30 years her senior, and her subsequent breakup.
In 2022, A published an essay containing intimate personal stories, including her encounters and breakup process with Baek.
Baek's side claimed that A violated the agreement not to disclose their 2013 relationship by publishing the book and filed a lawsuit.
In April 2022, the court made a partial citation decision, instructing the deletion of sensitive parts containing private information in response to Baek's interim injunction request.
